By entering the Channel Seven – “Jetty Road Staycation” giveaway you are agreeing to the following Terms and Conditions: DISCLAIMER: Facebook is not associated with any promotions conducted by Channel Seven Adelaide.

  1. STANDARD TERMS

1.1 Information on how to enter forms part of the terms of entry.

  1. WHO CAN ENTER?

2.1 Subject to clause 2.2, entry is open to all residents of South Australia, where the Channel Seven signal is received. Entrants must be over 18 years of age to enter.

2.2 Employees and their immediate friends and families of the Seven Network (Operations) Limited and their associated agencies and companies are not eligible to enter.

  1. HOW TO ENTER

3.1 The Competition commences Sunday November 10, 2019 at 5:30pm ACST and concludes on Wednesday November 13, 2019 at 5:30pm ACST (“the Competition Period”)

3.2 This competition is a game of skill. In order to enter, entrants must comment telling us why they would like to win the staycation.

3.3 Entries are limited to one entry per Facebook user.

3.4 Entries must be received by Wednesday November 13, 2019 at 5:30pm ACST.

  1. PRIZES

4.1 There will be one (1) winner who will receive the prize package detailed in clause 4.2.

4.2  1 night accommodation in a Grand Ocean Suite at the Stamford Grand ($600)
High Tea for two people at The Promenade Restaurant ($80)
Segway Tour for two people ($200) – Full terms and conditions can be found at bottom of this terms and conditions page
Moseley Beach Club Day Bed package ($100 food and beverage package redeemable on the day)
Jetty Road Gift Voucher ($100) (The voucher can be used in all the shops in the Jetty Road Glenelg precinct)

The prize is open to all, except employees and immediate family members of the Stamford Group.

Prize is for one-night accommodation for maximum of two people in the newly refurbished Grand Ocean Suite (room 822) and High Tea for two people in The Promenade Restaurant (to be redeemed together during one stay date).

48 hours’ notice is required for booking of this prize via phone reservation on (08) 8461 0394.

Prize is subject to availability and black-out dates may apply.

Prize must be redeemed before 30th April 2020.

Prize cannot be redeemed during 24th December 2019 to 1st January 2020 inclusive.

If prize is not redeemed, the prize is not transferrable or refundable.

Total maximum prize pool value for the prizes is $1080 (including GST). Prize value is correct as at the date of printing. The Promoter accepts no responsibility for change in prize value between now and the ultimate date on which the prize is taken.

4.3 In accepting the prize, the winner agrees to participate in and co-operate with all reasonable media editorial requests, including but not limited to, being interviewed and photographed, and the winner grants the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winner will not be entitled to any fee for such use.

4.4 The winner agrees they will not sell or otherwise provide their story and/or photographs to any media or other organisation.

4.5 It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the Promoter’s requirements.

4.6 In the event that an element of the prize outlined in the above is not available for any reason, the Promoter reserves the right to substitute with a similar product of equal or greater value, subject to state regulations.

4.7 Prizes cannot be sold, redeemed for cash or transferred.

4.8  The winners will be contacted by SA Weekender.

  1. HOW TO WIN

5.1 There will be one (1) winner selected based on the skills used to answer the competition question over the competition period.

5.2 The Promoter’s decision is final, and the Promoter will not enter into correspondence regarding the result.

5.3 The winner will be notified via a Facebook Messenger; they will then be required to send their contact details to SA Weekender via a direct Facebook message.  SA Weekender will contact the winner regarding prize redemption.

5.4 Winners must claim their prize by sending their details to SA Weekender in a direct Facebook message within 24 hours of being notified. In the event that any winner does not claim their prize within this period, the promoter will select another winner by the same means. Winners of any unclaimed prize will be notified by Facebook comment/message.

 5.5 It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and prize supplier’s requirements.

5.6 It is a condition of accepting the prize that the winner (and any companions) may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

  1. NO LIABILITY

6.1 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions, subject to state government legislation.

6.2 Seven Network (Operations) Limited & affiliates, Showtime Promotions and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur: a) during the selection process; b) whilst undertaking any travel won on or connected with their entry into the draw; c) in the participation in any prize; d) due to the broadcast of any program relating to the Competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person; e) arising from or related to any problem or technical malfunction of any Internet network or lines or communications network related to or resulting from participation in this Competition.

6.3 Seven Network (Operations) Limited assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries, and reserves the right to take any action that may be available.

6.4 If for any reason this Competition is not capable of running as planned, due to causes including but not limited to tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this Competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Competition, subject to state government legislation.

6.5In the event that prizes are required to be posted or couriered to winners, the Promoter cannot accept responsibility for loss or damage to prizes in transit. The Promoter makes no representations or warranties as to the quality/suitability of any of the goods/services offered as prizes. To the extent permitted by law, the Promoter is not liable for any loss suffered or sustained, to person or property and including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter, or its agents, in connection with the arrangement for supply, or the supply, of any goods or services by any person to the prize winner. This clause does not affect, and is not intended to affect, any rights a consumer might have, which are not able to be excluded under applicable Australian consumer protection laws.

 

  1. PROMOTER’S DETAILS

7.1 The Promoter is Seven Network (Operations) Limited (ABN 65 052 845 262) of Level 2, 38-42 Pirrama Road, Pyrmont, NSW 2009.

7.2 The sponsor is City of Holdfast Bay.

7.3 Entry details remain the property of the Promoter. Seven Network Limited (ABN 65 052 845 262) and its related entities (“Seven”), is collecting the entrant’s personal information for the purpose of conducting and promoting this Competition (including but not limited to determining and notifying winners), and, if you consent, for the purpose of Seven sending you Competition and direct marketing material in relation to Seven’s programs and products and services available through Seven and its business partners. The entrant may request access to his or her personal information by writing to, Channel Seven Adelaide., 40 Port Road, Hindmarsh SA 5007.

8 FINAL NOTE FACEBOOK

8.1 To the fullest extent permitted by law, the Entrant releases Facebook from any liability, loss (including consequential loss), damage, claims, costs, expenses, death or personal injury suffered or incurred by the Entrant arising out of, or in connection with, the Competition or the Prize. The Entrant acknowledges that the Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook.

Booking conditions

All bookings for Segway Sensation SA services are subject to the following conditions. Please read these carefully prior to making a booking.

Wet Weather policy

In the event of rain our tours will still operate. Segways are not affected by rain and according to our customers the puddles and bit of slush actually enhance the experience. We encourage all guests to dress weather-appropriately, and we can also provide complimentary rain ponchos.

If the rain becomes uncomfortably heavy at any time, we are able to retreat into the winery and enjoy a coffee (or another beverage) and wait until the rain lightens before resuming our tour, with more puddles! If necessary, we can adapt our schedule so that lunch can be enjoyed during the normal tour time and continue our Segway riding after our meal.

In the event that we are not able to provide the activity due to persistent rain, guests will be provided with a credit which they may use for a tour at another date of their choosing.

Cancellation policy

We understand that sometimes – even with the best of intentions – the best laid plans go awry. However from the time that you make your booking with us, we commit your places and hold them for you. This means that should someone else want to go on the tour you are booked on, we may not be able to take that person or people on the tour.

We ask you to please understand that, should you cancel your tour, you may be charged a cancellation fee. Cancellation fees for our Segway tours are as follows:

  • Cancellations received more than 14 days prior to the tour date will receive a full refund of the tour fee.
  • Cancellations received between 6 & 14 days prior to tour date will incur a cancellation fee of 50% of full tour cost.
  • Cancellations received within 5 days prior to tour date will incur a full cost of tour cancellation fee.
  • Please also note that failure to arrive for a scheduled tour will incur a full cost of tour fee and refunds will not be given for any part of a package or tour after the passenger has commenced the tour.
  • Please note also that a “cancellation” includes a change to the date of a tour booking that requires the original booking to be cancelled.

Alteration or Cancellation by Us

It is unlikely that we will have to make any changes to your booking after it has been confirmed. However, occasionally some changes have to be made.

In the event that we need to cancel or amend your booking, we will notify you as soon as practicable and offer you the opportunity to cancel and receive a full refund. In all cases our liability is limited to the amount of payment received by us. We cannot accept responsibility, or pay compensation, where we have to cancel a tour due to any unforeseen or unavoidable event beyond our control.

Segway Rider requirements

Riders failing to meet any of the following requirements will not be able to participate in any part of the proposed Segway Sensation SA Experience.

  • Riders must be at least 10 years of age.
  • Riders must wear a helmet. Helmets will be provided.
  • Riders must wear suitable footwear (e.g. trainers or comfortable shoes).
  • Riders must be able to stand for the duration of the experience
  • Riders must be able to step on-to and off the base of their machine unassisted (following training). The step is approximately 8 inches / 20 cm tall.
  • Riders must be able to lean from side to side and forwards and backwards, whilst standing upright on the machines.
  • Riders must not be under the influence of drugs or alcohol.
  • Riders must follow the instructions of their Guide – at all times – relating to all aspects of their Segway Sensation SA Experience. Failure to follow such instructions will result in the Segway Sensation SA Experience for the offending Rider being cancelled.
  • Riders must have adequate vision in order to safely operate a Segway PT, which can move at speeds up to 20km/h, and must wear any prescribed glasses where appropriate.
  • Riders must inform their Instructor of any vision impairments which may affect their safety before participating in a Segway Sensation SA Experience.
  • Pregnant women or people with back injuries and/or other serious health problems should not participate in any of Our Segway Experiences.

We reserve the right to prohibit any rider, prior to commencement, during training or during operation, from participating in any of our Segway experiences, if they fail to meet the Rider Requirements or do not maintain at the tour guide’s discretion and acceptable behaviour, as specified in these terms and conditions. In such cases, no refunds or alternative dates will be given.
